WHY AND HOW DO WE PROCESS PERSONAL DATA

1. GENERAL PROVISIONS

1.1. Under Article 4 par. 7 of the Regulation of the European Parliament and the Council (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “GDPR”), the controller of personal data is P&O Robotics s.r.o., Chelčického 1312/7, Jižní Předměstí, 301 00 Pilsen, ID No.: 09233717, Tax ID No.: CZ09233717 (hereinafter the “controller”)

1.3. The personal data include any information concerning an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

2. SOURCES AND CATEGORIES OF PERSONAL DATA PROCESSING

2.1. The controller processes personal data which you had provided to it and which the controller received on the basis of your order.
2.2. The controller processes your identification and contact details and data necessary for the fulfillment of a contract.

3. STATUTORY BASIS AND PURPOSE OF PERSONAL DATA PROCESSING

3.1. The statutory reason for the processing of personal data is the fulfilment of the contract between you and the controller under Article 6 par. 1 letter b) of the GDPR, the legitimate interest of the controller in providing the direct marketing (especially for the purposes of sending commercial communication and newsletters) under Article 6 par. 1 letter f) of the GDPR, your consent to the processing for the purposes of providing direct marketing (especially for sending commercial communication and newsletters) under Article 6 par. 1 letter a) of the GDPR in connection with Section 7 par. 2 of Act No. 480/2004 Coll., on certain services of informational companies in the case that no goods or services were ordered.
3.2. The purpose of personal data processing is the execution of your order and the performance of rights and obligations arising from the contractual relationship between you and the controller; each order requires you to provide personal data which are necessary for the successful execution of the order (first name and surname, contact information), while the provision of the personal data represents a necessary requirement for the conclusion and execution of the contract, and it is not possible to conclude or execute on the part of the controller without the provision of personal data, sending of commercial communication and performance of other marketing activities.

4. PERIOD OF MAINTAINING THE PERSONAL DATA

4.1. The controller stores the personal data for the period necessary for the performance of rights and obligations arising from the contractual relationship between you and the controller and the exercising of claims arising from these contractual relationships (for the person of 15 years after the termination of the contractual relationship), for the period until the consent to the personal data processing for the purposes of marketing is revoked, if the personal data are processed on the basis of a consent.
4.2. After the expiration of the period for the storing of personal data, the controller shall delete the personal data.

5. RECIPIENTS OF PERSONAL DATA

5.1. The recipients of personal data are persons which participate in the delivery of goods / execution of payments on the basis of the contract, provide the services of e-shop operation and other services in relation to the e-shop operation, providing marketing services.
5.2. The controller does not intend to hand the personal data to a third country (to a country outside the EU) or to an international organization. The recipients of personal data in the third countries are the providers of mailing services / cloud services.

6. YOUR RIGHTS

6.1. In accordance with the conditions specified in the GDPR, you have the right to access your personal data under Article 15 of the GDPR, to have the personal data rectified under Article 16 of the GDPR, or to secure restriction of the processing under Article 18 of the GDPR, to have the personal data erased under Article 17 of the GDPR, to object against the processing under Article 21 of the GDPR, to data portability under Article 20 of the GDPR, to revoke your consent to the processing in a written or electronic form to the address or e-mail of the controller specified in Article   III of these Terms and Conditions.
6.2. Furthermore, you have the right to submit a complaint with the Personal Data Protection Office if you believe that your right to the protection of personal data was violated.

7. CONDITIONS FOR THE SECURITY OF PERSONAL DATA

7.1. The controller declares to have adopted all reasonable technical and organizational measures to secure the personal data.
7.2. The controller adopted technical measures to secure the data repositories and the repositories of personal data in the documentary form.
7.3. The controller declares that only authorized persons are entitled to access the personal data.

8. FINAL PROVISIONS

8.1. By sending the order via the internet order form, you confirm to have made yourself/yourselves with the Terms and Conditions of the personal data protection and that you consent to them in their entire extent.
8.2. You consent to these Terms and Conditions by checking off the consent box via the internet form. By checking off the consent, you confirm to have made yourself familiar with the Terms and Conditions for the personal data protection that you consent to them in their entire extent.
8.3. The controller is entitled to change these Terms and Conditions. The new version of the Terms and Conditions shall be make public at the controller's website and the controller shall also send the new version of these Terms and Conditions to your email address which you provided to the controller.

9. EFFECT OF THE TERMS AND CONDITIONS

9.1. These Terms and Conditions come into effect on 1 January 2023.
